This lead to the couple choosing to create pre-embryos so that they could have a baby in the future if they so choose to. Upon creation of the pre-embryos they signed a document that stated that the embryos could not be used without the consent of both partners. Karla also met with an attorney and an agreement was made that karla is in control of the embryos if the couple were to separate, however, said document was not signed. Karla argued that she had custody of the pre-embryos and that she could use them to have children if she wanted to since they were hers. This is the first case in illinois that brings up the issue of who is in control of pre- embryos if a couple is to separate.
