How a case gets to the supreme court of the united states. After a dispute arises between two or more parties that cannot be solved outside of the legal realm, one party, the plaintiff, will file a complaint against the other party, the defendant. A complaint details the claims against the defendant and asks the trial court to resolve these issues. After the case is resolved in the trial court, the losing party appeals to an appellate court. The prior law may sometimes be called precedent: the idea that a court should follow prior decisions in resolving a current dispute is reflected in the doctrine of stare decisis. Congress, and state governments are all subject to the u. s. supreme court(cid:519)s power: application of prior law to facts and reasoning behind the decision. 1: holding and dicta, the (cid:522)holding(cid:523) is often the most important part of a case.
