Certiorari to the court of criminal appeals of alabama. Facts: petitioner evan miller was charged with murder and sentenced to life in prison at the age of 14-years-old. One day, miller was with his friend colby smith when they saw miller"s neighbor, cole cannon, drop by his house to make a drug deal with miller"s mother. The two boys followed cannon back to his trailer. There they spent a few hours drinking alcohol and smoking marijuana. A while later, cannon went unconscious due to excessive alcohol use. Cannon was unconscious miller and smith decided to steal several hundred dollars they found in his wallet. When miller attempted to place the wallet back in cannon"s pocket, cannon regained consciousness and grabbed miller by the throat. Smith then grabbed a baseball bat and attempted to beat cannon into letting go of miller. After miller was free form cannon"s hold, he took the bat from smith and began to beat cannon.
