Objective: we must conduct ourselves like a reasonable person of ordinary prudence in similar circumstances! Exible: allows consideration of all circumstances surrounding a particular accident! Relationship: a parent has a duty to keep their children safe, common carrier (bus co. , airplane) , college has duty to us (escort service at night)! If plaintiff injuries are the kind the statute was designed to protect against and the plaintiff is within the group the statute was designed to protect : example: package store selling liquor ! That person drives drunk and kills someone! That store is liable : 2) breach! Exposes someone else to foreseeable, unreasonable risk of harm ! Something the reasonable person would never do !
