On completion of this week"s online and in-class activities, you will be able to: explain the legal concept of consent. Common law, every competent adult can consent to and refuse medical treatment. Parental authority not absolute for blood transfusion. If parent says no to blood for child, human tissue act says they can still get it: understand the legal requirement of consent. Written, verbal or implied like holding out arm for blood test. Voluntary, informed, cover the procedure, patient has legal capacity. Child can give consent if they are competent for minor first aid, contraceptives etc: identify and describe the elements of trespass. Assault don"t need to touch someone. Can just be fear of being harmed (threats) Battery touching or striking someone without permission. False imprisonment restricting a pt. (doesn"t need physical contact: understand the concept behind patients" refusal of treatment.
