Those aciviies that are by mutual consent are a mater of the own individuals" business. Giomeshi one of the main issues was the issue of consent. Scc"s posiion of bdsm point of actual physical harm then the court"s posiion is that it doesn"t mater whether it"s consensual, it"s assault. Scc says that mutual consent doesn"t jusify harming one another, gives example of a bar ight (both paries agreed, sill consitutes assault) What consitutes consent and what consitutes assault is a grey area. The issue of physical contact in sports if you engage in hockey you are acceping the poss that you"re going to be hit (implied consent) Issue of mutual consent bedrock for what we can and cannot do.
