Section 718. 2 of criminal code encourages use of alternatives to incarceration, especially for. Judge ruled gladue not eligible for alternatives because she didn"t live in an aboriginal community. Judge sentenced her to 3 years in prison and gladue appealed to the supreme court of canada (scc) Scc upheld original sentence, but clarified section 718. 2. Purpose of section is to alleviate over-representation of aboriginals and offer alternative sanctions, such as restorative justice options. Aboriginals have a right to prepare a gladue report, which highlights ways offender has been marginalized. Scc made it clear that aboriginal offenders will not always benefit from a consideration of gladue factors.
