Document Summary

3 functions of law in maintaining social control: Law defines the behaviour subject to legal punishment. Law defines the institutions and procedures that will punish individuals. The act of trying and sentencing a person under criminal law is a way for society to condemn or reject the behaviour of the person. Purpose of criminal sanctions: utilitarian theory. Societal protection/incapacitation: retributive theory, educative theory of punishment. Incarceration is the main use of sanctions: our prison systems are dirty and gloomy, whereas other countries have nice, clean prisons. Rate of reoffending within 2 years: 40: us prisons are even worse, due to overcrowding, there are beds 1 foot from each other, and very little-no private areas. Rate of reoffending within 2 years: 67% Hours m 2:30-3:30, t 9:00-10:00: ex. In norway, their prisons are very nice (more like dorm rooms than prison cells), and they focus on rehabilitation instead of incarceration. Big enfaces on respect and reintegration into society.
