The term municipal is mentioned only twice in the 1867 constitution: municipal institutions in the province as one of the exclusive powers of the province. This is the basis for creatures of the province . Some say its a protection from arbitrary power from federal levels. Magnusson critiques this municipal subordination as it creates totalitarian provincial control. The creatures of the province is driven from an absolutist conception of sovereignty. This was an attempt to clear the confusion of multiple political authorities. Provincial control over local political institutions was at odds with the principles of a free and democratic society. This was progressive but it is outlived now. Why cant we apply the same progressive understanding of sovereignty when it comes to municipalities; this is a significant problem in acknowledging the potential of the people. Absolutist conception of sovereignty hinders the possibility of true local self-governance.
