Implantable computing also allows for more widespread and private surveillance. Depictions of this illustrates the concerns we have about our privacy and confusion about which parts of our lives can be listened to, viewed, or enhanced by this technology. Privacy scholars have questioned the possibility of using these tools. Courts have been hesitant to consider a strong right under the first amendment to get news in public places. Legislatures have been pushing to create more bans on private surveillance technological devices, like drones. This potentially leaves a gap to users of wearable and implantable computing devices and the people surrounding this technology. People might not be able to assert violations of privacy in court, but users of these devices may also have limited protection from the state if they get in trouble for using this technology.
