Use reasonable care standard under similar circumstances. Would injury have occurred but for defendant"s. D"s action was the legal cause of the harm that occurred. Assumption of the risk: you were injured because you assumed the risk of the injury; you presume you could be injured. Ex: go to a baseball game and got hit by the ball. I might have started it, but not the one that caused the injury. Does not get you out completely for negligence. Not a perfect defense but gets you out of some of the damages. Example: motorist hits bicyclist, and while bicyclist is lying on the ground injured, another car hits and kills the bicyclist.
