Unconscionable contract= it is so outrageous that it can"t be considered valid. Sometimes the court will say that all the elements of a contract are here, but the contract is so unconscionable it is so immoral/ unprincipled that i (the judge) will make it unenforceable. It resolves any issues of unfairness (usually with consideration u don"t care that much about fairness, but sometimes u do) something that is unconscionable is unenforceable. something that is so immoral and unfair, that it shocks the conscious. According to statory law it"s 18) anyone under the age 0f 18. A minor who enters into a contract, that contract is voidable at his/her guardian"s option. Student loans are enforceable even if a minor entered into it/ the guardian doesn"t want it. If a minor walks into a hospital and gets medical care, the provider can sue the parent and recover. The minor is not off the hook; meaning the guardian must pay the bill.
