Document Summary

The module examines the rediscovery of roman law in western europe and the rise of ius commune. Germanic law was the dominant factor in large parts of europe. The carolingian renaissance (9th c. ) brought to the revival of the idea of roman imperium. The empire of charlemagne had bipolar authoritarian structure of emperor and pope (two swords doctrine). 11th c. - investiture controversy- each side invoked the newly rediscovered roman law by its side. After the falling of the western part of the roman empire (476 ad) knowledge on roman law was lost. 6th-11th century- roman law competed with germanic tribal law (codes of governmental procedure and tariffs of compositions); 11th century- roman law was rediscovered as the basis for legal science; During the 5th century, western europe was divided into germanic tribal kingdoms. Germanic tribes followed the principle of personal law, unlike the romans- the principle of territorial law. Thus, everyone was a subject to the group he belonged.
