Document Summary
Bankruptcy fraud: crime occurs when a person devises a scheme to defraud by: filing a false bankruptcy statement; filing a false document in a bankruptcy proceeding; or making a fraudulent representation or claim in a bankruptcy case. Mail and wire fraud: must demonstrate that there is (1) a scheme to defraud, (2) which involves the use of the mail or wire communication, (3) for the purposes of executing the scheme. Ex: getting emails about winning a million dollars. Ex: you get an email from a friend that he has been robbed while in. London and has no money; you are asked to wire money to. The employee has the authority to do the particular corporate business which was conducted criminally. The employee was acting in part in furtherance of the business. Corporate management has authorized or tolerated the criminal acts: ex: bartender serving alcohol to a minor.
