Must find balance between specificity and elasticity. Much of what judges do at the appellate level is interpret the language of statutes. Most cases we read will involve the court (judge/judges only - no jury) Example: penal code provides enhanced penalty for a crime if the defendant uses a dangerous weapon . Judges must decide, in appellate cases, what constitutes a dangerous weapon . Gun, knife, even car or baseball bat, could be a fist too.
