Split between federal law has ultimate rule and states and local governments can act outside of the federal law. Form a more perfect union, establish justice, insure domestic tranquility, provide for the common defense, promote general welfare, and secure the blessings of liberty. People grant some of their power to the government. These are spelled out powers in the constitution. If it is not in the constitution, it is left to the people. Traffic laws, family laws, most crimes, torts, property law, contracts. The congress shall have the power to regulate commerce with foreign. Nations and among the several states and with the indian nations. Has the ability to effect inter state law. The fed government has been allowed to effect interstate but so do states. Both make laws that happen in the state. States cannot unduly burden interstate commerce or benefit intrastate interests over out of state interests. The government can affect state law by offering money.
