Class 10-11: sex, gender and the law: exclusion of women from the public sphere and refusal to regulate the private sphere. 1769: by marriage, the husband and wife are one in the law . < 19th century: married woman, feme covert is legally nonexistent. Husband can reclaim her if she goes away. Husband can sue for injuries to her. Women had no freedom to enter contracts. In some instances, women could petition to be relieved of restriction of coverture. 19th century: married women"s property acts removes worst of women"s legal disabilities. Suffrage - 19th amendment becomes law in 1920. Jury duty: 1961 hoyt v florida supreme court upholds conviction, by an all male jury, of a florida woman for murdering her husband. Exclusion of women from jury duty is found to be reasonable. Jeb v alabama: discrimination in jury selection based on gender is found unconstitutional.
