The Sixth Amendment states that all persons charged with a criminal case have the right
to counsel and the Fourteenth Amendment states that all due process of law cannot be denied by
any state. All the justices and juries were in favor of Gideon Wainwright because the states
cannot take away the privileges of the people.
This affects American policing in a huge way because this required state courts to follow
the same rule as the federal courts that they needed to provide any defendant the right to counsel.
This case is significant because this allowed any defendant to protect and defend themselves
against crimes the states deem unnecessary to appoint a counsel to the defendant, which puts the
defendant’s freedom in danger all because of the lack of knowledge of the law. Through this
case, all defendants no matter how minor the offense, has the right to a lawyer if they are unable
to afford one.
This case also proves an equal system of justice administration in that the criminal justice
system protects the poor and provides a clear standard for state courts to follow in terms of the
Sixth Amendment (the right to counsel). (Kashgegian, 2010, p. 5) Gideon v Wainwright has
allowed people to see the fundamental changes that take place in the maintaining a fair criminal
procedure in America.
Another significant case that we discussed was ‘Mapp v Ohio’. In the case of Mapp v Ohio, the
defendant was suspected of harboring a fugitive in her home. She refused the entry of police
officers into her home without a search warrant. When the police officers returned to her house
hours later, they showed Mapp a piece of paper that they claimed was a warrant. Mapp snatched
the paper and put it in her blouse.
