Result: battle of everybody against everybody else. No normative limitations on what a person is allowed to do; only boundaries: self-interest. Necessary to have an organization powerful enough to maintain peace. The state: creates laws + enforces them. State-duties: also duties for the citizens of the state. State creates framework in which self-interest of individuals is compatible with the interests of everybody else. Essential task of the state: enforcement of pre-existing rights. No limitations on the power of the state, because real limitations can only exist if they can be enforced by another entity such an entity shouldn"t exist. Trias politica: shows whether one part of the state remains remains within the limits created by the principle of legality.
