1) What are the legal ISSUES
2) What are the legal RULES
3) What is your ARGUMENT (Apply law to facts)
4) What is your CONCLUSION
In a Tort Law exam if you see something related to contracts DON’T WRITE
ABOUT IT
Issues and rules are related but not the same
Apply law to facts- One line intro and then look at issue 1 then write down what the
law is relating to the issue and pull out the facts and how they are related
If there are multiple issues do the IRAC method for each issue
Identify facts before answering the question according to IRAC
If the question asks you to advice a party look at WHAT LEGAL RIGHTS DO
THOSE PARTIES HAVE even if you’re only advising one party
Legal Rules- The legal principles from cases and legislation and apply those
principles to the fact
Need to include the section and provision within an act not just the act
Applying Law to facts-
- Legal principle using cases and legislation
- How will both parties use the law
- Why are the parties claim valid or not
