WHY CAN’T I USE EVERYTHING ON THE INTERENET?
Content on the internet is someone’s property, just like the content of someone’s
house or store, but instead of physical property it’s called intellectual property.
WHAT IS COPYRIGHT: Copyright is a form of legal protection for authors of original
works, whether they are published or unpublished.
WHY IS COPYRIGHT IMPORTANT: This law exists to make sure authors get rewarded for
their work and can control the way their work is used, providing a financial incentive for
those who create and share knowledge.
WHAT DOES COPYRIGHT PROTECT: Copyright law protects the expression of an idea
itself, not the underlying ideas or facts, this law is known as idea-expression dichotomy.
Therefore, an idea/fact is not copyright protected only the idea as an expression is
protected.
WHY IS IT IMPORTANT TO BALANCE PROTECTION & INNOVATION: Copyright
protection must balance the interests of creators and society at large. Protecting
copyright encourages individuals to create and innovate; on the other hand, when
society has access to these creations, that access also stimulates innovation.
WHAT ARE THE ISSUES: Copyright owners are concerned that their right to their work is
at risk and that new technologies, such as file sharing software, make it increasingly
easier to violate copyright by ‘stealing’ material. Access to work will affect revenue
systems.
WHEN DOES COPYRIGHT PROTECTION BEGIN?
HOW DOES MY WORK OBTAIN COPYRIGHT PROTECTION? Once you create an original
work, Copyright protects your original work as soon as its captured in physical form.
AND THAT MEANS? The work must be original.
WORK OF AUTHORSHIP: Includes many forms, including those not yet realized by new
technologies.
Literary books (poetry, plays, compilations, computer programs)
Musical works (music, lyrics)
Dramatic work (plays, including music)
Pantomimes and choreographic works
Pictorial, graphic and sculptural works (including architectural plans, 2D/3D art,
photos, maps, charts, computer graphics and models.)
Motion pictures and other audio-visual works (including scores, speech and sound
FX.)
Sound recordings, including music, speech, and sound not covered by motion
pictures and audio-visual works.
Architectural works
Fixed in tangible medium of expression refers to the form in which a work can be
viewed or experienced. To be protected, the work must be able to be observed,
reproduced or communicated. (e.g. paper, recordings, video, digital media.) Talking to
your dog about an idea for a movie and then later seeing a movie with a similar plot
