LLB105 Lecture Notes - Lecture 9: Statutory Interpretation
Document Summary
Shows your ability to analyse a problem, understand/interpret the law involved, and apply that to the problem. Real life skill that is used instinctively. Set of (hypothetical) facts, asking you to advise someone. This is not asking for you to write a letter to the client. This is not asking you to only consider the conclusions favourable to their position. It is asking you to be objective (sit in the position of a judge) and predict (with reasons) the outcome you think is most likely. S = for that issue, give statement/s of law. A = give an authority for that law. A = apply the law to the facts of the problem. S = give an overall conclusion at the end (synthesise) Issues are the result of you analysing the problem. This is the hardest part, but very important. You may need to do some background research (into the area of law) first.
