The law of contract; contents, interpretation of the contract, operation of the contract. A contractual term is any specified condition or proviso that forms a part of a contract. Any action or conduct that can be turned into a statement of fact. A statement of alleged fact either in negotiations or in court. A representation does not amount to a term of a contract, giving it rise to no contractual obligation however it may amount to a tort e. g. misrepresentation. Express contracts can be: entirely in writing, entirely oral, partly written and partly oral. Written contract may conflict with or not match with oral statements by one of the parties. So what happens: a false oral statement may give rise to liability for contravention of the australian consumer. Conditions: is a major term, of the contract which goes to the root of the contract.
