Ratio: unconscionable to permit the defendant to take advantage of the mistake, which everyone shared. Case: gillett v. holt ewhc (2000, p. 337) not on the exam. Facts: holt promises gillett legacies and life interest in property. Issue: whether promise creating a binding agreement i. e. was irrevocable and legally enforceable. Ratio: gillett had a right to equitable relief on the basis of detrimental reliance, gets minimum equity to do justice to the plaintiff, he was in a contract. It didn"t induce a change, because they already had to do it (b/c on the contract) Case: yeoman"s v. row (2008, ukhl, 348) not on the exam.
