Jordan house ltd. v. menow 1974 scc1: facts plaintiff was injured in an mva while walking along the centre line of a highway after being ejected from a hotel where he had become intoxicated. Plaintiff a well-known individual with the tendency to drink to excess and then to act recklessly. He had been barred from the hotel for a period of time, thereafter the employees were instructed not to serve him unless he was accompanied by a responsible persons. The night of the incident, plaintiffs company had left halfway through the night, in which the hotel staff continued to sell beer to the plaintiff past the point of visible intoxication. The staff then ejected the plaintiff knowing that he was unable to take care of himself by reason of intoxication and that he would have to go most likely by foot, near a highway.
