There is an ongoing conversation that happens between laws are made at parliament and the charter and how there interpreted by the court and with that interaction is how the criminal law is created. Mike duffy trial: multiple allegations of fraud in relations to his expenses, questions were raised about his expense claims as a senator, highly covered trial, 26 days, was charged with breach of trust and fraud. Multiple counts: he was acquitted, not sentenced because not found guilty. Acquitted- they can"t prove your guilty, not proven innocent but not guilty: the accused doesn"t have to prove anything; the crown just has to prove beyond a reasonable doubt. In a civil matter the plaintiff only needs to show its more likely than not. 50% +1 : beyond a reasonable doubt approach 100, has to be close doesn"t have to be actually, a person can be found guilty if it is theoretically possible that aliens took over their body.
