Criminal offenses have to be in the criminal code or some other regulated statute. They date back sometimes to the 12th century. What is a defense- not all defenses are justifications!! If something is excused it makes it less bad. Your excused for killing the person by reason of provocation so instead of murder manslaughter. If its justification it doesn"t just make it less bad but turns it into something good. Killing someone to stop them from killing a child. The first line of defense is always on the facts.
