The criminal code guides sentencing for adults, the youth criminal justice act guides sentencing for youth. If under 12, you cannot be charged criminally in canada. This age bracket deals with the age the individual was when the crime was committed, not the age of the individual when caught or when the trial occurs. However if at a young age you committed a crime that was eligible for a jail sentence, and you are tried at age 20 or above, you will serve that jail time in an adult sentence. Once you turn 20 you leave the youth facility and serve the rest of your sentence in adult prison. Ycja section 38 gives the principles around sentencing minors, section 39 covers the criteria stating when a young person may go to jail.
