Intoxication often marked as critical deviation from rationalized/responsiblized norms of explicit consent standard: used to accuse victims of risk behaviour + to absolve accusers of risky behaviour. What does this tell us: establishing legal parameters of consent is complex, current conceptualizations of legal consent continue to embody gendered & heteronormative assumptions. Improvements have been made, but still work to be done. The most prominent example of gendered assumptions at work in current legal treatments of consent relate to cases of sexual exploitation and age of consent laws. Dauda states in her article, these laws are framed as child protection laws specifically meant to. This assumes that females, especially young females, are more likely to be victims and males the perpetrators. Another example of gendered assumptions at work in current legal treatments of consent are depicted in cases of sexual assault.
