Lecture 3 crime, law, process, and politics: charter application. Usually, anytime that you have a violation of these two rights, the issue is normally dealt at the front end of the trial and not so much in the actual trial itself. This makes sense because before you go to trial you need to actually get to that point as well as have information about disclosure. This process starts that same way as a notice of application just like we learned last week. There is an application filed that requires 2 steps to come to a conclusion where s. 24(2) was used. This was used anytime that: 24(2) applies specifically to any situation where there is specific evidence obtained and that is the basis of the issue. However, it terms of the two sections below, it is section 24(1) that deals specifically with chatter violations not involving specific evidence issues: section 11(b)
