Adversarial: judge is not involved in collecting evidence or interviewing witnesses. Defense and prosecution presenting evidence to judge and jurors. Judges see evidence, go to crime scene etc. (cid:498)let"s find the truth by working together(cid:499) Primarily used in criminal cases: only about 20% or cases have jurors. Jury selection: representativeness (cid:498)jury of one"s peers(cid:499) Juror needs to set aside on biases or prejudices. Voir dire: calling individuals (summons) to court house at specific date and time. In order to be eligible you must be 18+ (ont), must be. Canadian, no criminal record, certain occupations exempt (ex police officer: lawyers question you to be selected or not. Dismiss potential juror based on lawyer"s discretion. Asked 555 judges about recent jury trials. Results: percent of all trials (kalven & zeisel, 1966)
