The ratepayers filed an application to the divisional court to stop the building of the dedicated streetcar lane. After the decision was rendered, the city investigated matlow and discovered that there was conflict of interest. Justice matlow was biased in favour of the ratepayers. It was discovered that justice matlow lives in the st. clair neighbourhood and that he has been previously involved with campaigns dedicated to stopping the construction of large residential and retail building on the toronto parking authority lot. Justice matlow should have recused himself prior to the hearing before the divisional. Even though the conflict of interest was not discovered until after the hearing, there should have been a request for a new hearing in front of another panel of judges; and have the original decision struck out.
