The ongoing years of contract is TENURE

Board must provide: orientation, mentoring, PD and Training for all new
teachers

New teacher completes 2 satisfactory ratings in a 12 month period and you
get a permanent contract (test question!)

Occasional Contract
Taking over for a teacher on leave
-
May be included in NTIP
-
Redundancy
Contract dictates how many teachers a school has depending on school
population- student teacher ratio
-
Critical for school to have students to keep teachers, run programs

High competition

If staff reduction is deemed necessary redundancy is based on seniority (even
by 1 day)

Teacher must be notified by a specific date (usually in spring), does not mean
you will not be back, just at that point student/teacher ratio does not look good
for next year, it may change and you are re-hired

Termination
Teachers may terminate contract at end of June

Written notice

If board terminates your contract when it needs to explain to union why

Again written proof (absences, poor evaluations, written up)

Accidents, fights etc that may cause injury.. You don’t want this to be because
of you negligence

Teachers are to perform duties from a parental perspective (duty of care)

Duty of care
Teachers have a duty of care to protect their students from all reasonable risks
of injury or harm

Foreseeability. Plan ahead, anticipate potential risks, and address these

Due Diligence
Did you do your due diligence if a student was hurt? Were you negligent?

Your obligation is to NOT act in a negligent fashion
-
Some activities inherent danger, just act with high duty of care
-
Proof of negligence
Based on proof that the harm was reasonably foreseeable and you did nothing
to prevent it

Then there is breach of duty
-
Duty of care also relates to instruction/training.. Did you train before activity

Reduce Liability
Ie. Degree of supervision required, training to prepare for the activity

If this student was my child, what would I, as a careful parent, do to fulfill my
duty of care?

Duties to your fellow teachers
Adverse report on another member they must be furnished with a written
statement first UNLESS it is suspected sexual abuse

Teacher candidate cannot make negative statements about their associate
unless you write them a statement first

Exception
Unless they disclose a significant difficulty to their faculty advisor or the
placement office.. This is deemed a confidential conversation
