A legal process which encourages parties who have separated to work with their lawyers or other professionals in order to avoid; To achieves a settlement that meets the need of the parties and children. That does not go into the process of litigation. The voluntary process is within collaborative law is in effect when a couple signs a contract, referred to as a participation agreement. It is also in effect when each party agree to be committed to the process and neither party can use their lawyer or law firm if the issue goes to formal law. Emotion: is the biggest difference when resorting got collaborative law because it recognises the emotional issues felt by the parties. Many of you have heard of disputing party"s spending thousands of dollar arguing about pest when the realities is that they are arguing about psychological pain.
