Procedure for bringing an application is set out in part 6 rules of court. Either made ex parte [without notice] or on notice. Applications are heard in chambers by a justice of qb or by a master in chambers. Master = quasi judge who has jurisdiction in most litigation applications. In judicial districts where a master is available, one should proceed to masters chambers for interim applications. Applications to vary or rescind an order by a judge. Applications to have a civil trial heard with a jury. Notice of application is not required to be given to any other party or person affected by the proceedings. It is not necessary to draft, file and serve the notice document called an application. It is only necessary to prepare an affidavit in support of the application and a draft order. Minor corrections can be handwritten on the order and initialed by the master/justice.
