Only 5/28 Canadian Prime Ministers since
confederation were not lawyers.
This alone demonstrates the importance of
lawyers in Canadian governments and policy
making.
The overriding rule of lawyers in society is to
protect the Rule of Law.
Magna Carta, or Great Charter
- originally signed in 1215 between
English King John & his barons.
- Purpose: the king could no longer act
in an arbitrary way, but was required
to follow a fair legal process in all
things.
- The Charter was repeatedly
confirmed and expanded by
subsequent British monarchs and by
the British Parliament.
No single definition of the Rule of Law.
Everyone is accountable to the law, and laws
must be promulgated and enforced fairly.
The Rule of Law is not a defined statute
or common law rule.
It is an overarching principle that governs the
creation of laws and their implementation
in democratic nations.
The rule of law governs their creation &
implementation!
The implementation of the Rule of Law
requires constant vigilance.
The rule of law cannot be set and then
forgotten.
Lawyers, whether they practice privately, work for the
government, work as in-house counsel, or work doing research
and policy development, are essential to the protection of this
fundamental principle of democracy.
