To understand the legislative and judicial framework in which employment laws arise and are enacted and enforced. All legislation and the common law must conform to the constitution. Establishes canada"s system of government, including the division of powers between the federal government and the provinces and territories. Establishes and confirms the essential rights and freedoms of all canadians through the charter of rights and freedoms. Employment laws are passed by parliament or the ontario legislature. E. g. , employment standards act, human rights code. They address topics as minimum wage, hours of work, overtime pay, and mandatory leaves. These are laws made by the courts (judge-made law). They establish legal precedents and standards for determining employment law issues for those areas of the law not covered by statute or the constitution.
