Ncrmd- individual must have had a mental disorder that deprived her of the capacity to appreciate the nature and quality of the act or omission or to know that it is morally wrong. Ncrmd is not acquitted but held at a psychiatric hospital or supervised in the community if he poses a significant threat. Nature and quality of the act or omission: Ncrmd and automatism is concerned with the issue of criminal responsibility and focused on the state of the mind of the accused person at the time of the alleged offence. The courts have interpreted these criteria in a narrow manner so it is difficult to establish that an accused person is unfit to stand trial. Low iq does not met the standard, low threshold. Issue must be raised by one of the arties and can be raised at any point during the trial.
