Governmentality shift from pre classical (torture) to classical (punishment) Church/monarchical power dissipates capitalism replaces feudal system (class system) No longer did spectacle of torture have social control need for more humane law. Shift relies on rule of law equal application. Immergence of the prison/jail take away rights (not arbitrary)
