Gay rights were never criminalized in latin america. Some countries are improving, some are going backwards in rights. Gay marriage enacted by congress in 2010 through a reform of the national civil code. First country in latin america and tenth in the world to allow it. While the judiciary placed the issue on the agenda, it was approved through the legislature. Gay marriage, regulated by the federal civil code, is not allowed. Supreme federal court ruled (2011) that civil unions should be recognized through the country. National council of justice ordered (2013) all notary publics to register civil unions as marriages upon request. Civil union bill approved by senate in october, and currently being discussed by the lower chamber. Constitutional court ordered (2011) congress to legislate on the matter within two years. Congress failed to do so, and the result is legal uncertainty. Gay marriage first enacted by mexico city in 2010.
