In canada we have two models: crime control main goal is to reduce crime, deterrence- want to lower crime as much as possible. Discretion- assumption that their discretion is just and justifiable. Judges administrative bureaucrats, everyone is treated the same. Correctional facilities: need prisons for them to go. Sentences: make sentences longer and harsh including mandatory minimums. Death penalty: used as means to protect society also used as a deterrence. Deterrence: general and specific deterrence (when a person goes through their own personal experience by being punished) 1st degree murder with a woman in a high profile case who was stabbed. He was denied bail and took it to the supreme court. The supreme court denied him bail because they wanted to maintain public confidence and safety. Due process- through protection of law abiding persons. Protection-protecting individuals from powers of the state. Prevention- protecting innocent people from being convicted.
