Law and social change: legal institutions have been found to have a definite role, rather poorly understood, as instruments that set off, monitor, or otherwise regulate the fact or pace of social change. Sacred concept of marriage: a traditional view, a permanent contract with god. Duty to the church, soc iety, and family. Social concept of marriage: a traditional view, focuses on social obligations. Personal concept of marriage: a modern view, gives priority to individual rights and desires. Jurisdiction: federal government legislates for marriage and divorce. Provincial government solemnizes, legislates for matrimonial property and custody, and resolves disputes. Common law: a conjugal relationship between a c ouple in which no legal marriage has taken place. Bill c-38: legalized same sex marriages i n july 2005.
