Roman laws allowed inds. to argue cases on behalf of others, called orators there were also jurists: inds. who are knowledgeable about the law. Imperial period (44 bc to 410 ad) = lawyers begin to practice law for a living, as a profession. Crucial element in professionalization process = market control. Lawyers = in a position of trust sometimes use this illegally (committing unethical actions): can no longer practice law/various punishments judge/jury = neutral time consuming process, expensive, undermine respect for judicial system (the rich = hire best lawyers) Reasons for suing lawyers: negligence: to be successful in suing them, lawyer has have shown degree of incompetence. Client = only one who can dismiss lawyer from their case. Most of the time, done by verbal contract = speed process. Works best for the wealthy = best lawyers who can make best deals lawyers = often working for the rich against the poor inequality.
