workplace accommodations (modified hours/duties), and training; discrimination;
disability benefits that preclude paid work (even part-time)
Results of employment equity:
-slow pace of change but some successes
-criticisms from opponent side include that it is inadequately monitored and enforced,
inadequate coverage and has been less effective tackling racial discrimination
-criticisms from opponent side include administration costs and that it undermines
meritocracy
The Meiorin case (1999)
-was fired because she failed a fitness test that required her to run 2.5km in 11 minutes
-went to supreme court of Canada where they found her a victim or gender
discrimination
-ruled that aerobic performance standards had not been demonstrated to be necessary
to the safe, efficient performance of the job
-record did not show whether women and men require the same minimum level or
aerobic capacity to perform this job safely and efficiently

Inequalities and differences: Migrant labour
“Most migration today is linked indirectly or directly by the search for decent work
opportunities.”
Immigration in Canada has historically been tied to labour requirements, with the responsible
department housing: “agriculture and immigration”, “employment and immigration”.
Non-Immigrant Employment Authorization Program
-“roots” can be traced to the need for agricultural labour and eventual development of
the Seasonal Agricultural Worker Program
-implemented in 1072, NIEAP established legal category of “foreign worker” and
allowed for entry of temporary migrant workers across a broader range of occupations
Temporary Foreign Worker Program
-expansion evolved into the Temporary Foreign Worker Program with introduction in
2002 of the Low Skill Pilot Project
-aimed at addressing employer demand for workers to perform jobs requiring lower
levels of skill
