According to the canadian sentencing commission, sentencing is defined as the judicial determination of a legal sanction to be imposed on a person found guilty of an offence (canadian sentencing commission, 1987, 153) Sentencing requires the judge to make an effort to balance the needs of society, the offender and the victim of the crime. Sentencing occurs after a finding of guilt or after a plea. Sentencing is often limited by legal parameters with the criminal code identifying maximums and minimums with certain offences. The maximum sentence in canada is a life sentence which is an indefinite term. For first degree murder parole eligibility is after 25 years. Respect for the law and the maintenance of a just and peaceful and safe society. Section 718 of the criminal code of canada states: To deter the offender and other persons from committing offences. To separate offenders from society where necessary. To provide reparations for harm done to victim/community.
