Actus reus physical act or omission (the absence of acting where there is a legal duty to act) Degrees of blameworthiness intent is the highest degree. The moral purposeful the action, the more serious the act is. It is not having a motive, more so what you intended to do in the act. Recklessness = didn"t mean for the thing to happen, but you foresaw the consequences, you had knowledge that something wrong could happen but didn"t intend for it to happen. Willful blindness = state of mind where the wrongdoers chooses to remain ignorant in. Reckless driving when the act is being committed. Summary conviction, indictable, hybrid true crime, regulatory. Summary convictions are less serious (noise complaints) prison = 3 months or less. Indictable offenses are more serious (kidnapping) prison = 2 years or less. Hybrid offenses prosecution has discretion to decide if summary or indictable (indecent exposure)
