What is a contract? o o o o. A document agreed upon by two or more people. Unilateral: one person making the statement or offer ("i will do if ") o subjected to higher scrutiny. Did these two people actually understand their mutual obligations? o. Sales - cup of coffee, purchase of a car purchasing goods and services, receipt is evidence of a contract o o o. Employment - work occupation with time limit, know your rights, payment. Representation - representing a bigger party (company), unions (one person is legal representative), legally binding terms accepted through that representative. Comes from case law --> civil law most common --> common law. Important for globalization and businesses to harmonize contract law o o o o o. Contract is given the benefit of doubt, can contract universally anything. Can sign away your inalienable god-given rights (in some circumstances) Criminal code ex: a contract to assassinate another individual.
