Locke needs the idea of the state of war: his idea of state of war is different than hobbes. you can be in the state of war with something even when your preservation is preserved perfectly. Locke is concerned with peace, that the sovereign can promise peace. Hobbes wants to seek peace by giving your power to an all powerful sovereign. but for locke doing that doesn"t promise your liberty. Locke says the concept of liberty is not doing what you wish to do. Freedom is not from the law but it comes through the law. Leaving the state of nature has to be a matter of your consent. Locke says, you have to mix labour with it, a locking proposal which ensures you leave enough and as good for others. a spoilage clause, you cant take so much in your hands that it will spoil.
