SOC209 – Lecture 1 • What is a crime  a breach of the law, is not a crime without the law • Behaviour in which breaks the law • Necessary actions must be prohibited • Actions must have criminal intent  mens rea • Mens rea prerequisite of criminal mind (guilty mind) • 3 distinct degrees: 1. Intent 2. Knowledge 3. Recklessness • Mental resolve to commit a crime  intent • Perpetrator knew some harm may come out of it  knowledge • Appropriate care and affection was not there  recklessness • Criminal liability: actus rea and mens rea • Actus rea: act of a crime must be there • Ex1) can declare yourself as a drug addict, but you must be seen doing the act of consuming drugs or in possession of them
