Jeremy bentham (1748-1832): rational choice: people act on their own self-interest, max their benefit and minimum their pain, people make rational choice, weigh their interests and pain. When law maker increasing the punishment, it suppose to prevent people to do this crime. Certainty: how likely to do this, how odd if i do this, more important than severity. Problem: people sometimes do not act rationally, do not consider the longtime consequence, the consequence of sending people to the prison is different. Maybe is not a big deal to go to prison or maybe it is big deal (4) specific. Majority people that being send to jail have been already been there before. Does not explain the certain crime, such as in the hit crime. People always minimized the possibility that they will be caught when they make choice.
